New Environmental Priority Sites Certificate strengthens environmental due diligence for Victorian property transactions

SERV and LANDATA® today announced the release of its Environmental Priority Sites Certificate (EPSC), a fully automated, statewide report designed to support property due diligence and compliance across Victoria.
The EPSC provides clear, structured information on a property’s proximity to sites listed on the EPA’s Priority Sites Register (PSR), helping vendors, purchasers and advisers make informed decisions during the sale process.
The Priority Sites Register identifies properties that have been issued formal notices in relation to pollution, contamination, environmental action or clean-up under the Environment Protection Act 2017. Properties located in the vicinity of a Priority Site may also be affected by environmental issues. The EPSC assesses whether a searched property falls within 250 metres of a listed Priority Site, based on a consistent and transparent methodology.
Commonly included in Section 32 Statements (Vendor Statements) prepared under the Sale of Land Act 1962, the EPSC supports compliance with section 32D(a), which requires disclosure of any notice, order, declaration, report or recommendation of a public authority directly and currently affecting the land, of which the vendor might reasonably be expected to have knowledge. By clearly identifying whether a property is considered to be in the vicinity of a Priority Site, the EPSC assists vendors and their advisers in meeting disclosure obligations and provides buyers with relevant environmental context at the point of sale. The certificate offers full statewide coverage, enabling consistent reporting for any property in Victoria. Through precise geolocation of each Priority Site and linkage to all properties on theVictorian land register, the EPSC delivers accurate and comprehensive location identification. This automated approach supports timely turnaround, with certificates issued via email within one business day.
