Land Registry Lodging Book

New stocks of the Land Registry Lodging Book are being printed and will be on sale early December 2006. The price will remain at $77 inclusive of GST.

The reprinted book will be a revised version of the third edition and will include identified corrections and changes that have resulted from updates to legislation and Regulations.

For the benefit of customers who already have the third edition of the Land Registry Lodging Book, the complete list of the corrections and changes to be included in the revised version of the book is set out below.

Throughout the book

The phrases “Legal Practice Act 1996” and “Current Practitioner under the Legal Practice Act 1996” have been replaced with “Legal Profession Act 2004” and “Australian Legal Practitioner under the Legal Profession Act 2004” respectively.

References to “Transfer of Land (Fees) Regulations 1993” have been replaced with “Transfer of Land (Fees) Regulations 2004”.

References to “Subdivision (Registrar’s Fees) Regulations 1993” have been replaced with “Subdivision (Registrar’s Fees) Regulations 2004”.

Section 3 – Transfer of Land Act 1958

• Page 2 – Section of Act 74(1) now reads 74(1)(b)
• Page 3 – An additional item has been added to the contents. The item now reads: “Adverse Possession Lodgement Checklist 100”.

• Page 5 – Fee – Miscellaneous Item 7 has been replaced with Schedule 2 Item 2.
• Page 6 – Fee – Miscellaneous Item 7 has been replaced with Schedule 2 Item 3.
• Page 11 – Fee – Miscellaneous Item 7 has been replaced with Schedule 2 Item 6.
• Page 12 – Fee – Miscellaneous Item 7 has been replaced with Schedule 2 Item 7.
• Page 15 – Fee – Miscellaneous Item 7 has been replaced with Schedule 2 Item 8.

• Page 17 – Fee – Sec. 26R has been replaced with Schedule 2 Item 11.
• Page 17 – “Application: (Office of Titles application no.):” has been inserted below the area headed “Estate or interest claimed”.
• Page 27 – “Consent of council required if carriageway, way easements created” has been included in the Lodging Requirements.
• Page 48 – Lodging Requirements – “Adverse Possession Lodgement Checklist” has been included.
• Page 55 – Duty – The words “Not Payable” now appear adjacent to DUTY.

Note: Duty on leases and arrangements for leases was abolished from 26 April 2001 and is no longer required to be paid on leases executed on or after that date.

Page 74 – Fee – Miscellaneous Item 7 has been replaced with Items 59 and 60.

Page 87 – In FORM 50 (Section 98CA(1)) the following line has been deleted: “Service company (full name of service company)”.

Pages 91, 92 – Fee – Sec. 103 has been replaced with Item 76.

Page 93 – Fee – Sec. 103 has been replaced with Item 74.

Pages 94, 95, 99 – Misc. Item 7 has been replaced with Misc. Item 2.

Page 96 – Fee – Item 25 has been replaced with Item 27.

Page 100 – This page was blank, but now contains a sample of the Adverse Possession Lodgement Checklist (Section 60 TLIA1958).

Section 4 – Subdivision Act 1988

Page 1 – The Contents page now shows the page number for the “Subdivision Act Plan Lodgement Checklist” as 54 (previously shown as 55).

Pages 3, 5, 7 – Note 2 has been deleted. Note 3 has been renumbered as Note 2.

Page 4 – Lodging requirements: “If easements or restrictions are varied or removed by the plan then the supporting documents under Section 61(1)(i) or (k) of the Subdivision Act 1988 must be produced” has been deleted.

The statement “Abstract of Field Records and Surveyor’s Report if based on Surveyor’s Report” has been replaced with: “Surveyor’s report Abstract of Field Records (if based on survey).”

Page 6 – Lodging requirements: “If easements or restrictions are varied or removed by the plan then the supporting documents under Section 61(1)(i) or (k) of the Subdivision Act 1988 must be produced” has been deleted.

The statement “Surveyor’s Report” Abstract of Field Records may be required if the stage plan has been prepared by a different surveyor than the original survey or is prepared more than five years after the date of the original survey.”
