Subdivision (Registrar’s Requirements) Regulations 2011
The Subdivision (Procedures) Regulations 2000 will sunset on 9 October 2011 and be replaced by two new sets of regulations – the Subdivision (Registrar’s Requirements) Regulations 2011 and the Subdivision (Procedures) Regulations 2011.
The current regulations, which prescribe time frames, forms, procedures and other matters necessary for the certification of plans of subdivision by local councils and their registration by the Registrar of Titles, include some ambiguities. The two new sets of regulations will remove the existing ambiguities and improve the efficiency of processing and registering plans of subdivision.
The new regulations, detailed below, commence on 8 October 2011.
Subdivision (Registrar’s Requirements) Regulations 2011
These regulations will regulate matters relating to the registration of plans of subdivision by the Registrar of Titles. These are areas for which the Minister for Environment and Climate Change has ministerial responsibility.
The content of the Subdivision (Registrar’s Requirements) Regulations 2011 is similar to the provisions of the existing regulations because they relate to the role of the Registrar of Titles in registering subdivisions, but with improvements to:
- facilitate consistency across industry in the way that building subdivisions are interpreted and represented including:
- introducing default locations for building boundaries with associated explanatory diagrams;
- requiring clear distinction between any building boundaries, easements and structures on a plan;
- reflect changes in existing administrative practices (e.g. Section 35 acquisition plans cannot be lodged unless accompanied by the relevant vesting documentation).
Subdivision (Procedures) Regulations 2011
These regulations will regulate the role of local governments in certifying plans of subdivision prior to lodgement with the Registrar. These are areas for which the Minister for Planning has ministerial responsibility.
Transition period
Adhering to the new regulations for new plans will not be mandatory until 8 October 2012; however customers are encouraged to comply with the legislation as soon as possible.
